Please read these Terms of Service carefully before using Gifty. These terms constitute a legally binding agreement between you and Gifty regarding your use of our platform and services.
1. Acceptance of Terms
By accessing or using Gifty you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the service. We may update these terms from time to time; continued use constitutes acceptance of any changes.
2. The Service
Gifty allows you to create personalised greeting cards attached to digital experience credits (concerts, spa days, adventures, etc.). Cards are physically printed and delivered to your chosen recipient by post. Experience credits are fulfilled via our partner platforms and are subject to each partner's own terms and conditions.
3. Accounts
You must be 18 years or older to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Please notify us immediately if you suspect unauthorised access.
4. Orders and Payment
All prices are listed in GBP and include VAT where applicable. Orders are confirmed on receipt of payment. We reserve the right to cancel an order if we are unable to fulfil it, in which case a full refund will be issued. We deliver to UK addresses only. A card sent straight away is printed within 1–3 working days and then posted, and most arrive within about a week. If you choose first class delivery at checkout (£0.99 extra), it usually arrives within 2–4 working days. If you choose an arrival date at checkout, we hold the card and post it in time to arrive by that date. A date too soon for free delivery needs a faster delivery method, which costs extra (first class £0.99, express £5.99 or next-day courier £11.99); checkout shows the price before you pay. Delivery times are estimates and may vary.
5. Cancellations and Refunds
You may cancel your order for a full refund within 24 hours of purchase, provided the card has not yet been sent to print. Once the card is in production or has been despatched, we are unable to offer a refund for the physical card. Experience credits that have not been redeemed may be refunded in line with the partner platform's policy.
6. User Content
You are solely responsible for any video messages, text, or images you upload. You must not upload content that is defamatory, offensive, unlawful, or infringes third-party intellectual property. We reserve the right to remove content that violates these terms without notice.
7. Prohibited Uses
You may not use Gifty for any unlawful purpose; to send spam or unsolicited communications; to impersonate any person or entity; to attempt to gain unauthorised access to our systems; or to transmit any viruses or malicious code.
8. Intellectual Property
All card designs, brand assets, and platform code are owned by Gifty and protected by copyright. You may not reproduce, distribute, or create derivative works without our express written permission.
9. Limitation of Liability
To the fullest extent permitted by law, Gifty shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability shall not exceed the amount you paid for the relevant order.
10. Governing Law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
